Abstract

This brief article details the two 1999 cases of Lustig-Prean and Beckett v. the United Kingdom and Smith and Grady v. the United Kingdom. The European Court of Human Rights held that the United Kingdom's policy of excluding homosexual individuals from the armed forces due solely to their sexual orientation was a violation of the European Convention for the Protection of Human Rights and Fundamental Freedoms. As a result, the United Kingdom eliminated all restrictions on gay individuals in the military.
